Terms & conditions

Terms governing use of the We Stay Maldives website and our role as your independent travel planning partner.

Effective date: 2 June 2026

These terms ("Terms") govern your access to https://westaymaldives.com and your use of planning services offered by We Stay Maldives ("we", "us", "our"). By using this website or engaging us to arrange travel, you agree to these Terms. If you do not agree, please do not use the site.

We are an independent Maldives travel specialist. We are not the owner or operator of resorts, guest houses, airlines, or transfer services unless expressly stated otherwise in a written confirmation.

1. About our service

We provide travel planning, availability checks, written proposals, and booking coordination for stays and experiences in the Maldives. Marketing content on this site—including descriptions, imagery, and indicative pricing—is for general information. A binding arrangement exists only when you accept a written proposal or confirmation that specifies property, dates, inclusions, price, and payment terms.

2. Website use

You agree to use the website lawfully and not to:

  • Attempt unauthorised access to our systems or data
  • Scrape, overload, or disrupt the site or its infrastructure
  • Misrepresent your identity or submit false inquiry information
  • Copy, reproduce, or commercially exploit site content without our written permission

We may suspend or restrict access if we reasonably believe these Terms have been breached.

3. Inquiries and proposals

Inquiry forms collect the details needed to prepare a tailored quote. Submitting an inquiry does not guarantee availability or price. We aim to respond promptly during business hours (Maldives time, Sunday–Thursday, and by arrangement on other days).

Written proposals remain valid only for the period stated on the document. Prices and inclusions can change if a supplier amends rates, taxes, or policies before you confirm and pay a deposit.

4. Bookings, deposits, and payment

When you accept a proposal:

  • Deposits and balances are due by the dates and methods stated in your confirmation (bank transfer, card, or other channel we specify)
  • Payment to us or directly to a supplier constitutes acceptance of the supplier's booking conditions as incorporated into your confirmation
  • Failure to pay on time may result in cancellation of holds and loss of deposits, per the applicable cancellation policy

You are responsible for bank charges, currency conversion, and any fees your payment provider applies unless we state otherwise in writing.

5. Prices and inclusions

Confirmed prices include only what is listed in your written confirmation—typically accommodation, meal plan (if stated), transfers as specified, and taxes or levies quoted at booking time. Optional extras (spa, diving, premium beverages, green tax or environmental levies introduced after booking, etc.) are payable separately unless explicitly included. We will flag material exclusions before you deposit.

6. Cancellations, changes, and refunds

Cancellation and amendment rules are set by each resort, guest house, airline, and transfer operator, as reflected in your confirmation. These often vary by season and rate type. We will communicate applicable deadlines and penalties before you commit.

Change requests after confirmation are subject to supplier approval and may incur fees. Refunds, when due, are processed according to the supplier's policy and our payment timeline; processing through banks may take additional business days.

We strongly recommend comprehensive travel insurance that covers cancellation, medical costs, and disruption.

7. Your responsibilities as a traveller

You are responsible for:

  • Valid passports, visas, and health or vaccination requirements for the Maldives and any transit countries
  • Accurate guest names and dates as required by suppliers (errors may incur amendment or cancellation charges)
  • Arriving on time for domestic flights, seaplanes, and speedboat transfers; missed connections due to late arrival may be non-refundable
  • Observing resort and local laws, including environmental and marine protection rules
  • Disclosing relevant medical, mobility, or dietary needs in advance so we can advise on suitability

8. Force majeure

Neither party is liable for failure or delay caused by events beyond reasonable control, including severe weather, natural disaster, pandemic restrictions, government action, strike, or failure of essential utilities or transport systems. In such cases we will work in good faith with suppliers on rebooking or credits according to their policies and funds received.

9. Limitation of liability

To the fullest extent permitted by applicable law:

  • We are not liable for acts, omissions, or insolvency of third-party suppliers, including accommodation, transport, and activity providers
  • We are not liable for indirect, consequential, or special loss (including lost enjoyment or profit) arising from use of the site or travel arranged through us
  • Our aggregate liability arising from a confirmed booking is limited to the service fees paid to us for that booking, except where liability cannot be limited by law (including death or personal injury caused by our negligence where applicable)

Nothing in these Terms excludes rights you may have under mandatory consumer protection laws in your country of residence.

10. Intellectual property

Site text, design, logos, and curated photography are owned by or licensed to We Stay Maldives. You may view and print pages for personal, non-commercial use. Any other use requires our prior written consent.

11. Complaints

If something goes wrong during your trip, contact us as soon as practicable so we can liaise with the supplier while you are still on property. After travel, email reservations@westaymaldives.com with your booking reference and we will investigate in line with supplier policies.

12. Governing law and disputes

These Terms are governed by the laws of the Republic of Maldives, without regard to conflict-of-law principles. Courts in Malé shall have exclusive jurisdiction unless mandatory consumer law in your home country requires otherwise. We prefer to resolve disputes amicably before formal proceedings.

13. Changes to these Terms

We may update these Terms from time to time. The effective date above will change when we do. Your continued use of the website after publication constitutes acceptance of the updated Terms where permitted by law. Confirmed bookings remain subject to the Terms in effect when you accepted the relevant proposal, except where a change is required by law.
